VILLAGE OF WALTHILL

September 27, 2023

A special meeting of the Chair and the Village Board of Trustees of Walthill, Nebraska was held at the Village Office in said village immediately following the budget hearing, September 27, 2023.

Present:  Board Chair Michael Grant, Trustees Gwen Porter, Waylon Oldman and Curtis Boschult.  Trustee Aaron Brown was absent from the meeting.  Also present:  Lisa Beaudette, Clerk/Treasurer.

Visitor:  None.

Notice of meeting was given in advance thereof by posting in three (3) public places, a designated method for giving notice, as shown by the certificate of posting notice on file at the Village Office.  Notice of the meeting was simultaneously given to the Chair and Trustees and a copy of their acknowledgment of receipt of notice and agenda are on file at the Village Office.  Availability of the agenda was communicated in the public notice.  All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.

Chair Grant called the meeting to order at 12:35 p.m. and made the public aware of the availability of the open meeting laws.

Trustee Porter made a motion to increase the total restricted funds authority by an additional 1%.  Trustee Oldman seconded the motion and upon roll call vote the following voted aye:  Grant, Porter, Oldman and Boschult.  Nay:  None.  Absent:  Brown.  Motion carried.

A motion was made by Porter, seconded by Oldman to set the final tax request at a different amount than the prior year request.  Upon roll call vote, the following voted aye:  Grant, Oldman, Porter and Boschult.  Nay:  None.  Absent:  Brown.  Motion carried.

Trustee Oldman made a motion to introduce the following resolution and moved its adoption:

Resolution No. 2023-6

SETTING THE 2023-2024 PROPERTY TAX

WHEREAS, Nebraska Revised Statute 77-1632 AND 77-1633 provides that the Governing Body of the Village of Walthill passes by a majority vote a resolution setting the tax request; and

WHEREAS, a special public hearing was held as required by law to hear and consider comments concerning the property tax request;

NOW, THEREFORE, the Governing Body of the Village of Walthill resolves that:

  1. The 2023-2024 property tax request be set at:

General Fund: $ 31,613.00

Bond Fund: $ 76,255.00

  1. The total assessed value of property differs from last year’s total assessed value by 9.37 percent.
  2. The tax rate which would levy the same amount of property taxes as last year, when multiplied by the new total assessed value of property would be 1.423228 per $100 of assessed value.
  3. The Village of Walthill proposes to adopt a property tax request that will cause its tax rate to be 1.356846 per $100 of assessed value.
  4. Based on the proposed tax request and changes in other revenue, the total operating budget of the Village of Walthill will increase last year’s budget by 26.88 percent.
  5. A copy of this resolution be certified and forwarded to the County Clerk on or before October 15, 2023.

Trustee Boschult seconded the motion for the foregoing resolution and on a roll call vote, the following voted aye:  Grant, Oldman, Porter and Boschult.  Nay:  None.  Absent:  Brown.  Motion carried.

Chair Grant opened the One & Six Year Street Plan Hearing at 12:37 p.m. for support, opposition, criticism, suggestions or observations.

Details of the street plan were discussed.  There were no questions by the public.

Chair Grant closed the One & Six Year Street Plan Hearing at 12:38 p.m.

Trustee Boschult made a motion to introduce the following resolution and moved its adoption:

Resolution No. 2023-7

WHEREAS, the City Street Superintendent has prepared and presented a One Year and Six Year Plan for Street Improvement Program for the Village of Walthill, and

WHEREAS, a public meeting was held on the 27th day of September 2023, to present this plan and there were no objections to said plan;

THEREFORE, BE IT RESOLVED by the Chairperson and Village Board of Trustees of Walthill, Nebraska, that the plans and data as furnished are hereby in all things accepted and adopted.

Trustee Boschult made a motion to introduce the following resolution and moved its adoption:

Resolution No. 2023-8

SIGNING OF THE MUNICPAL ANNUAL CERTIFICATION OF PROGRAM COMPLIANCE 2023

WHEREAS: State of Nebraska Statutes, sections 39-2115, 39-2119, 39-2120, 39-2121, and 39-2520(2), requires an annual certification of program compliance to the Nebraska Board of Public Roads Classifications and Standards; and

WHEREAS: State of Nebraska Statute, section 39-2120 also requires that the annual certification of program compliance by each municipality shall be signed by the Mayor or Village Board Chairperson and shall include the resolution of the governing body of the municipality authorizing the signing of the certification.

BE IT RESOLVED that the Village Board Chairperson of the Village of Walthill is hereby authorized to sign the Municipal Annual Certification of Program Compliance.

Trustee Oldman seconded the motion for the foregoing resolution and on a roll call vote, the following voted aye:  Grant, Porter, Oldman and Boschult.  Nay:  None.  Absent:  Brown.  Motion carried.

Discussion was held regarding the resignation of the Clerk/Treasurer. 

As there was no further business, a motion was made by Boschult, seconded by Porter to adjourn.  Upon roll call vote, the following voted aye:  Grant, Oldman, Porter and Boschult.  Nay:  None.  Absent:  Brown.  Motion carried.
