VILLAGE OF WALTHILL

December 7, 2022

The regular meeting of the Chair and the Village Board of Trustees of Walthill, Nebraska was held at the Village Office in said village at 5:00 p.m., December 7, 2022.

Present:  Board Chair Michael Grant, Trustees Gwen Porter, Aaron Brown, Curtis Boschult, and new board member Waylon Oldman.  Also present:  Lisa Beaudette, Clerk/Treasurer, KayCe Henneman, Deputy Clerk/Treasurer, Roger Anderson, Maintenance, and Paul Wingett, Maintenance.  Kevin Connot, Planner/Developer and Matt Munderloh, Village Attorney, attended via zoom.

Visitors:  None.

Notice of meeting was given in advance thereof by posting in three (3) public places, a designated method for giving notice, as shown by the certificate of posting notice on file at the Village Office.  Notice of the meeting was simultaneously given to the Chair and Trustees and a copy of their acknowledgment of receipt of notice and agenda are on file at the Village Office.  Availability of the agenda was communicated in the public notice.  All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.

Chair Grant called the meeting to order at 5:01 p.m. and made the public aware of the availability of the open meeting laws.

Re-elected board members, Mike Grant and Gwen Porter, and new board member, Waylon Oldman, were sworn in by Matt Munderloh, Village Attorney.

Clerk Beaudette conducted the nominations for temporary Board Chair.  Trustee Brown made a motion, seconded by Porter to nominate Curtis Boschult as temporary Board Chair.  Upon roll call vote, the following voted aye:  Grant, Porter, Brown, Boschult and Oldman.  Nay:  None.  Motion carried.

Temporary Board Chair Boschult conducted the nominations for permanent Board Chair.  Trustee Porter made a motion, seconded by Brown to nominate Michael Grant as permanent Board Chair.  Upon roll call vote, the following voted aye:  Grant, Porter, Brown, Boschult and Oldman.  Nay:  None.  Motion carried.

Chair Grant conducted the nominations for Vice Chairperson with the authority to sign checks and warrants and Chair meetings in the absence of the Chair.  Chair Grant made a motion, seconded by Brown to nominate Gwen Porter as Vice Chairperson.  Upon roll call vote, the following voted aye:  Grant, Porter, Brown, Boschult and Oldman.  Nay:  None.  Motion carried.

A motion was made by Grant, seconded by Boschult to approve Aaron Brown as an alternate check signer.    Upon roll call vote, the following voted aye:  Grant, Porter, Brown, Boschult and Oldman.  Nay:  None.  Motion carried.

Nominations were in order for Clerk/Treasurer.  Trustee Brown made a motion, seconded by Boschult to retain Lisa Beaudette as Clerk/Treasurer.  Upon roll call vote, the following voted aye:  Grant, Porter, Brown, Boschult and Oldman.  Nay:  None.  Motion carried.

Nominations were in order for Village Health Board.  Chair Grant made a motion, seconded by Boschult to nominate Gwen Porter as the appointee for the Village Health Board.  Upon roll call vote, the following voted aye:  Grant, Porter, Brown, Boschult and Oldman.  Nay:  None.  Motion carried.

Nominations were in order for Street Superintendent.  Trustee Boschult made a motion, seconded by Porter to appoint Brent Ciecior, S-1689, Class A as the 2023 Certified Street Superintendent.  Upon roll call vote, the following voted aye:  Grant, Porter, Brown, Boschult and Oldman.  Nay:  None.  Motion carried.

Nominations were in order for Village Attorney.  Trustee Brown made a motion, seconded by Boschult to nominate Matt Munderloh and/or Johnson & Mock Law Office as Village Attorney.  Upon roll call vote, the following voted aye:  Grant, Porter, Brown, Boschult and Oldman.  Nay:  None.  Motion carried.

Committee Delegations were made as follows:  Kevin Connot and Trustee Boschult were appointed to the Infrastructure Committee;  Trustees Porter and Brown appointed to the Finance Committee;  Chair Grant and Trustee Oldman appointed to the Solar/Renewable Energy Committee;  Chair Grant and Trustee Porter appointed to the Parks and Recreation Committee;  and Kevin Connot and Trustee Oldman appointed to the Economic Committee.

A motion was made by Boschult, seconded by Brown to retain all Village employees at their negotiated salaries and present positions.  Upon roll call vote, the following voted aye:  Grant, Porter, Brown, Boschult and Oldman.  Nay:  None.  Motion carried.

Trustee Boschult made a motion, seconded by Brown to approve the minutes of the November 9, 2022 board meeting.  Upon roll call vote, the following voted aye:  Grant, Brown, Boschult, and Oldman.  Nay:  None.  Abstain:  Porter.  Motion carried.

Trustee Porter made a motion to introduce the following resolution and moved its adoption:

RESOLUTION #2022-14

SIGNING OF THE YEAR-END CERTIFICATION OF CITY STREET SUPERINTENDENT 2022

    WHEREAS:  State of Nebraska Statutes, sections 39-2302, and 39-2511 through 39-2515 details the requirements that must be met in order for a municipality to qualify for an annual Incentive Payment;  and

    WHEREAS:  The State of Nebraska Department of Transportation (NDOT) requires that each incorporated municipality must annually certify (by December 31st of each year) the appointment of the City Street Superintendent(s) to the NDOT using the Year-End Certification of City Street Superintendent form;  and

    WHEREAS:  The NDOT requires that each certification shall also include a copy of the documentation of the city street superintendent’s appointment, i.e., meeting minutes;  showing the appointment of the City Street Superintendent by their name as it appears on their License (if applicable), their License Number (if applicable) and Class of License (if applicable), and type of appointment, i.e., employed, contract (consultant, or interlocal agreement with another incorporated municipality and/or county), and the beginning date of the appointment;  and

    WHEREAS: The NDOT also requires that such Year-End Certification of City Street Superintendent form shall be signed by the Mayor or Village Board Chairperson and shall include a copy a resolution of the governing body authorizing the signing of the Year-End Certification of City Street Superintendent form by the Mayor or Village Board Chairperson.

    BE IT RESOLVED that the Village Board Chairperson of the Village of Walthill, Nebraska, is hereby authorized to sign the attached Year-End Certification of City Street Superintendent completed form(s).

    ADOPTED this 7th day of December, 2022 at Village of Walthill, Nebraska.

Trustee Brown seconded the motion for the foregoing resolution and on a roll call vote, the following voted aye:  Grant, Porter, Brown, Boschult and Oldman.  Nay:  None.  Motion carried.

Trustee Porter made a motion, seconded by Brown to approve Brenda Ball to fill the Library Board Vacancy.  Upon roll call vote, the following voted aye:  Grant, Porter, Brown, Boschult and Oldman.  Nay:  None.  Motion carried.

Kevin Connot, Planner/Developer, gave a community development report for the Board to review.

Trustee Boschult made a motion, seconded by Brown to authorize Matt Munderloh and Kevin Connot to solicit requests for qualifications for a preliminary engineering report on the Village water system and provide assistance with funding applications.  Upon roll call vote, the following voted aye:  Grant, Porter, Brown, Boschult and Oldman.  Nay:  None.  Motion carried.

Street Light/Pole Project was discussed – no board action taken.

Roger Anderson, Maintenance, gave a monthly Maintenance Department report.

Trustee Brown made a motion, seconded by Boschult to pay up to $2,500.00 in transportation costs of the Village’s street sweeper to Mid Iowa Solid Waste in Des Moines, Iowa for repairs.  Upon roll call vote, the following voted aye:  Grant, Porter, Brown, Boschult and Oldman.  Nay:  None.  Motion carried.

KayCe Henneman, Property Manager, gave an update on the Village’s rental properties.

Discussion was held on 8-Plex Facility Cleaning – no board action taken.

Treasurer’s report for October 2022 was submitted for the Board’s consideration.  Since there were no objections, the report was filed.

Trustee Porter made a motion, seconded by Grant to increase all Village employee wages by 5.9% beginning January 1, 2023.  Upon roll call vote, the following voted aye:  Grant, Porter, Brown, Boschult and Oldman.  Nay:  None.  Motion carried.

Trustee Boschult introduced Ordinance #2022-5 entitled:

AN ORDINANCE TO SET VILLAGE EMPLOYEES SALARIES AND MILEAGE RATE

and moved the statutory rule requiring reading on three days be suspended.  Trustee Brown seconded the motion to suspend the rules and on a roll call vote, the following trustees voted aye:  Grant, Porter, Brown, Boschult, and Oldman.  Nay:  None.  The motion to suspend the rules was adopted by a majority of all members of the board that were present and the rule was declared suspended for consideration of said ordinance.

Said ordinance was then read by title and thereafter Trustee Boschult moved for final passage of the ordinance, which motion was seconded by Trustee Brown.  The Chairperson then stated the question “Shall Ordinance #2022-5 be passed and adopted?” Upon roll call vote, the following trustees voted aye:  Grant, Porter, Brown, Boschult, and Oldman.  Nay:  None.

The passage and adoption of said ordinance having been concurred in by a majority of all members of the Board of Trustees, the Chairperson declared the ordinance adopted and the Chairperson in the presence of the Board of Trustees signed and approved the ordinance and the Clerk attested the passage and approval of the same and affixed her signature thereto.  A true, correct and complete copy of said ordinance is as follows:

AN ORDINANCE TO SET VILLAGE EMPLOYEES SALARIES AND MILEAGE RATE

BE IT ORDAINED by the Village Board of Trustees of Walthill, Nebraska:

SECTION 1: The Village of Walthill, Nebraska hereby sets the salaries for the following employees:

Roger Anderson $43,971.20 per year

Fred Appleton $46,758.40 per year

Lisa Beaudette $55,473.60 per year

KayCe Henneman $39,977.60 per year

Paul Wingett $40,976.00 per year

James Randol Sr $45,489.60 per year

Jesse Boschult $40,206.40 per year

Nola Briggs $14.93 per hour

Lucille BigFire $13.24 per hour

SECTION 2: The mileage rate is set at the State of Nebraska rate.

SECTION 3: This ordinance shall be effective beginning January 1, 2023.

SECTION 4: This ordinance repeals any ordinance or part of ordinance in conflict thereof; and shall be in full force after its passage and publication as required by law.

A motion was made by Grant, seconded by Porter to encourage Village employees during the holidays to continue to show up for work, to be prompt and to be timely, and in exchange for doing this, pay Full-Time employees a premium of $1,000.00 and Part-Time employees a premium of $500.00 by December 23, 2022.  Upon roll call vote, the following voted aye:  Grant, Porter, and Oldman.  Nay:  Brown and Boschult.  Motion carried.

The bills were audited and a motion was made by Grant, seconded by Porter, to approve payment.  Upon roll call vote, the following voted aye:  Grant, Porter, Brown, Boschult, and Oldman.  Nay:  None.  Motion carried.

No Law Enforcement Report for November 2022 was provided.

The Board received Police Officer Clyde Porter’s resignation letter effective December 7, 2022.

Trustee Boschult made a motion, seconded by Brown to hire Ansley Griffin Jr. as a Full-Time permanent employee at $25.00 an hour, conditioned on the passing of the reciprocity exam within 60 (sixty) days and signing a one-year contract, subject to renewal, effective as of the completion date of training.  Upon roll call vote, the following voted aye:  Grant, Porter, Brown, Boschult and Oldman.  Nay:  None.  Motion carried.

The Part-Time Applicant will be reviewed by the new Police Officer, Ansley Griffin Jr.

As there was no further business, a motion was made by Porter, seconded by Boschult to adjourn.  Upon roll call vote, the following voted aye:  Grant, Porter, Brown, Boschult and Oldman.  Nay:  None.  Motion carried.
