VILLAGE OF WALTHILL

August 9, 2023

The regular meeting of the Chair and the Village Board of Trustees of Walthill, Nebraska was held at the Village Office in said village at 5:00 p.m., August 9, 2023.

Present:  Board Chair Michael Grant.  Trustees Aaron Brown, Waylon Oldman and Trustee Curtis Boschult arriving at 5:03 pm.  Trustee Gwen Porter was absent from the meeting.  Also present:  Lisa Beaudette, Clerk/Treasurer, Kevin Connot, Community Developer, Ansley Griffin Jr., Police Officer and James Randol Sr., Community Service Officer.  Matt Munderloh, Village Attorney was present via zoom.

Visitors:  Ed Encinas and Bill Olson.

Notice of meeting was given in advance thereof by posting in three (3) public places, a designated method for giving notice, as shown by the certificate of posting notice on file at the Village Office.  Notice of the meeting was simultaneously given to the Chair and Trustees and a copy of their acknowledgment of receipt of notice and agenda are on file at the Village Office.  Availability of the agenda was communicated in the public notice.  All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.

Chair Grant called the meeting to order at 5:00 p.m. and made the public aware of the availability of the open meeting laws.

Trustee Brown made a motion, seconded by Oldman to approve the minutes of the July 5, 2023 board meeting.  Upon roll call vote, the following voted aye:  Brown, Grant and Oldman.  Nay:  None.   Absent:  Porter and Boschult.  Motion carried.

There were no visitors present.

Kevin Connot gave a verbal Community Development report during which Trustee Boschult arrived at 5:03 p.m.

A motion was made by Oldman, seconded by Brown to approve submittal of a letter of interest for a 500 KW solar project through the PACE Program.  Upon roll call vote, the following voted aye:  Grant, Oldman, Boschult and Brown.  Nay:  None.  Absent:  Porter.  Motion carried.

There was no maintenance report for July 2023.

Bill Olson gave a proposal for tree removal in the amount of $14,000.00 upon which Trustee Oldman made a motion to approve the proposal.  Brown seconded the motion and upon roll call vote, the following voted aye:  Oldman, Brown, Grant and Boschult.  Nay:  None.  Absent:  Porter.  Motion carried.

An update was given regarding the splash pad.  The Village Board directed the Maintenance Department to make sure the splash pad was operational for the 2024 season.

A Theft of Service policy was discussed.  Attorney Matt Munderloh will formulate an ordinance based on the discussion for passage at the September board meeting.

An update on the Village’s rental properties was given by the Clerk.

Trustee Grant introduced Ordinance #2023-5 entitled:

AN ORDINANCE OF THE VILLAGE OF WALTHILL, NEBRASKA, PROVIDING THOSE PORTIONS OF A PLATTED, BUT UNIMPROVED RIGHT-OF-WAY IN THE VILLAGE OF WALTHILL, NEBRASKA, AND ABUTTING THE FOLLOWING DESCRIBED REAL ESTATE, SHALL BE VACATED, TO WIT:  LOTS 1 AND 2, BLOCK 22, THIRD FILING; LOTS 6, 7, 8, 9, AND 10, BLOCK 23, THIRD FILING; AND THE SOUTH 33’ OF LOT 36, AND ALL OF LOTS 37 AND 38, PARK ADDITION; PROVIDING THE OWNERS OF THE ABUTTING REAL ESTATE SHALL TAKE TITLE TO THE PORTIONS OF THE RIGHT-OF-WAY SO VACATED; REPEALING CONFLICTING ORDINANCES AND SECTIONS; AND PROVIDING AN EFFECTIVE DATE.

and moved the statutory rule requiring reading on three days be suspended.  Trustee Oldman seconded the motion to suspend the rules and on a roll call vote, the following trustees voted aye:  Grant, Brown and Oldman.  Nay:  None.  Abstain:  Boschult.  Absent:  Porter.  The motion to suspend the rules was adopted by a majority of all members of the board that were present and the rule was declared suspended for consideration of said ordinance.

Said ordinance was then read by title and thereafter Trustee Oldman moved for final passage of the ordinance, which motion was seconded by Trustee Brown.  The Chairperson then stated the question “Shall Ordinance #2023-5 be passed and adopted?” Upon roll call vote, the following trustees voted aye:  Grant, Brown and Oldman.  Nay:  None.  Abstain:  Boschult.  Absent:  Porter.

The passage and adoption of said ordinance having been concurred in by a majority of all members of the Board of Trustees, the Chairperson declared the ordinance adopted and the Chairperson in the presence of the Board of Trustees signed and approved the ordinance and the Clerk attested the passage and approval of the same and affixed her signature thereto.  A true, correct and complete copy of said ordinance is as follows:

ORDINANCE NO. 2023-5

AN ORDINANCE OF THE VILLAGE OF WALTHILL, NEBRASKA, PROVIDING THOSE PORTIONS OF A PLATTED, BUT UNIMPROVED RIGHT-OF-WAY IN THE VILLAGE OF WALTHILL, NEBRASKA, AND ABUTTING THE FOLLOWING DESCRIBED REAL ESTATE, SHALL BE VACATED, TO WIT:  LOTS 1 AND 2, BLOCK 22, THIRD FILING; LOTS 6, 7, 8, 9, AND 10, BLOCK 23, THIRD FILING; AND THE SOUTH 33’ OF LOT 36, AND ALL OF LOTS 37 AND 38, PARK ADDITION; PROVIDING THE OWNERS OF THE ABUTTING REAL ESTATE SHALL TAKE TITLE TO THE PORTIONS OF THE RIGHT-OF-WAY SO VACATED; REPEALING CONFLICTING ORDINANCES AND SECTIONS; AND PROVIDING AN EFFECTIVE DATE.

BE IT ORDAINED BY THE CHAIRPERSON AND BOARD OF TRUSTEES OF THE VILLAGE OF WALTHILL, NEBRASKA:

Section 1.  Those portions of a platted, but unimproved right-of-way in the Village of Walthill, Nebraska, and abutting the following described real estate, shall be and hereby are vacated, to wit:  Lots 1 and 2, Block 22, Third Filing; Lots 6, 7, 8, 9, and 10, Block 23, Third Filing; and the South 33’ of Lot 36, and all of Lots 37 and 38, Park Addition.

Section 2.  Title to any and all lots and land affected hereby shall revert to the owners of the abutting lots and land, and become part of such property, pursuant to and on terms consistent with Nebraska law, and subject to the following, to wit:  there is reserved to the Village the right to maintain, operate, repair, and renew public utilities existing as of the date of this Ordinance, and there is reserved to the Village, any public utilities, and any cable television systems the right to maintain, repair, renew, and operate water mains, gas mains, pole lines, conduits, electrical transmission lines, sound and signal transmission lines, and other similar services and equipment and appurtenances, including lateral connections or branch lines, above, on, or below the surface of the ground that are existing as valid easements as of the date of this Ordinance for the purposes of serving the general public or the abutting properties and to enter upon the premises to accomplish such purposes at any and all reasonable times.

Section 3.  The Village Clerk shall, within thirty (30) days after the effective date of vacation, file a certified copy of this Ordinance with the County Clerk / Register of Deeds of Thurston County, Nebraska, to be indexed against all affected lots and lands. 

Section 4.  Any other ordinance or section passed and approved prior to the passage, approval, and publication or posting of this Ordinance and in conflict with its provisions is hereby repealed.

Section 5.  This Ordinance shall take effect and be in full force from and after its passage, approval, and publication or posting as required by law.

The Treasurer’s report for April 2023 was submitted for the Board’s consideration.  Since there were no objections, the report was filed.

Trustee Boschult made a motion to introduce the following resolution and moved its adoption:

RESOLUTION #2023-5

LEAGUE ASSOCIATION OF RISK MANAGEMENT 2023-2024 RENEWAL

WHEREAS, The Village of Walthill is a member of the League Association of Risk Management (LARM);

WHEREAS, section 8.10 of the Interlocal Agreement for the Establishment and Operation of the League Association of Risk Management provides that a member may voluntarily terminate its participation in LARM by written notice of termination given to LARM and the Nebraska Director of Insurance at least 90 days prior to the desired termination given to and that members may agree to extend the required termination notice beyond 90 days in order to realize reduced excess coverage costs, stability of contribution rates and efficiency in operation of LARM; and

WHEREAS, the Board of Directors of LARM has adopted a plan to provide contribution credits in consideration of the consideration of certain agreements by members of LARM as provided in the attached letter.

BE IT RESOLVED that the governing body of The Village of Walthill, Nebraska, in consideration of the contribution credits provided under the LARM Board’s plan, agrees to:

  • Provide written notice of termination at least 180 days prior to the desired termination date, which date shall be no sooner than September 30, 2026. (180 day and 3-year commitment; 5% discount)

Trustee Brown seconded the motion for the foregoing resolution and on a roll call vote, the following voted aye:  Grant, Brown, Oldman and Boschult.  Nay:  None.  Absent:  Porter.  Motion carried.

The bills were audited and a motion was made by Brown, seconded by Boschult, to approve payment.  Upon roll call vote, the following voted aye:  Brown, Boschult and Grant.  Nay:  None.  Abstain:  Oldman.  Absent:  Porter.  Motion carried.

Discussion was held on the teepee mural final payment.  Upon discussion, Boschult made a motion, seconded by Brown to make final payment of $4,000.00 after touch ups and inspection.  On roll call vote the following voted aye:  Grant, Brown and Boschult.  Nay:  None.  Abstain:  Oldman.  Absent:  Porter.  Motion carried.

Monthly reports were submitted by Officer Griffin and James Randol Sr. for the Board’s review.

Oldman made a motion, seconded by Boschult to approve execution of the Federal Bureau of Investigation Siouxland Safe Trails Taskforce Memorandum of Understanding.  Upon roll call vote, the following voted aye:  Oldman, Brown, Grant and Boschult.  Nay:  None.  Absent:  Porter.  Motion carried.

Discussion was held regarding the 2023-2024 Budget and meeting date.

As there was no further business, a motion was made by Oldman, seconded by Boschult to adjourn. 

Upon roll call vote, the following voted aye:  Brown, Boschult, Grant and Oldman.  Nay:  None.  Absent:  Porter.  Motion carried.
