RESOLUTION

OMAHA TRIBAL COUNCIL

No. 20-54

RE:  AMENDED:  Shelter in Place Order for Omaha Tribe Reservation and CURFEW

WHEREAS:  the Omaha Tribe of Nebraska is federally recognized Indian tribe of organized under a constitution and bylaws approved by the Secretary of Interior on April 30, 1936, pursuant to Section 16 of the Indian Reorganization Act of June 18, 1934;  and

WHEREAS:  pursuant to Article III, Sec. I of the constitution of the Omaha Tribe of Nebraska, the governing body of the Omaha Tribe shall also be known as Tribal Council;  and

WHEREAS:  pursuant to Article IV, Sec. 1 (g) of the constitution of the Omaha Tribe of Nebraska the governing body of the Omaha Tribe shall also be known as Tribal Council;  and

WHEREAS:  the Omaha Tribal Council recognizes the reality and severity of the threat presented by the COVID-19 Pandemic, heightened by a lack of medical and material resources (venilators, hospital beds, etc.) within the Indian Health Service, the Omaha Tribe, and the State of Nebraska and State of Iowa, that in the interest of preserving the Health, Safety, and Welfare of the Omaha People, the Omaha Tribal Council strongly advises the Omaha People to adhere to the following guidelines in order to prevent the spread of COVID-19;  and

WHEREAS:  the Omaha Tribal Council recommends the adoption of a Temporary Curfew Order as a necessary preventative measure to mitigate the spread of COVID-19;  and

WHEREAS:  the law enforcement of Omaha Tribe will collaborate with local and county law enforcement authorities in the enforcement across the reservation as necessary;  and

WHEREAS:  in order to keep tribal members and other residents of the Omaha Tribe Reservation safe and after consultation with the tribal Health Department, the Omaha Tribal Council believes that is in the best interest of the Omaha Tribe, and the tribal membership and all residents living within the boundaries of the Omaha Tribe Reservation to enact a Temporary Curfew Order.

NOW THEREFORE, BE IT RESOLVED:  the Omaha Tribal Council adopts the Temporary Curfew Order to be followed by all persons within the boundaries of the Omaha Tribe Reservation while the COVID-19 pandemic remains a threat to the tribal membership and all people who reside on the Omaha Tribe Reservation;  and

BE IT FURTHER RESOLVED:  that the Omaha Tribal Council finds this Temporary Curfew Order between the hours of 8:00 p.m. through 8:00 a.m. beginning April 17, 2020, necessary in order to minimize in-person interaction, which is the primary means of transmission of COVID-19;  and

BE IT FINALLY RESOLVED:  that this resolution will remain in effect no longer than necessary to ensure that COVID-19 no longer poses a public health threat;  and

NOW THEREFORE BE IT RESOLVED:  Recognized guidance for Shelter in Place Order.

1.  Shelter-In-Place.  Stay home and self-quarantine until further notice.  A week to week update will be made by tribal council.

2.  Do not make social visits - minimize interaction with other community members.

3.  Travel only as absolutely necessary (i.e. grocery shop, for medical appointments, etc.) and shelter immediately upon return.

4.  Practice social distancing by staying at least 6 feet apart from others.

5.  No public gatherings through the duration of the COVID-19 Pandemic Emergency including at the parks and the courts.

6.  If you have any of the following symptoms immediately self-isolate and call the numbers listed below:

  • Fever (temperature above 100.4)
  • Cough (especially if a dry cough)
  • Shortness of Breath
  • Sudden Loss of Taste and/or Smell

If you have been in contact with someone whom is sick or has been diagnosed with COVID-19,

  • Between 8:00 a.m. and 4: 30 p.m. Monday through Friday, call Carl T. Curtis Health Center at (402) 837-5381 and ask for the Triage Nurse.
  • Between 4:30 p.m. and 8 a.m. Monday through Friday, call the 12 Clans Hospital Hotline at (402) 922-1508.
  • Saturday and Sunday, 24-hours, call the 12 Clans Hospital Hotline at (402) 922-1508.

These measures are absolutely necessary to ensure the health, safety, and well-being of the membership of the Omaha Tribe because of the identified lack of medical resources in the State of Nebraska and State of Iowa.  This order is subject to modification and change by the Omaha Tribal Council.

This Temporary Curfew Order has been enacted by the Omaha Tribal Council and applies to all persons within the boundaries of the Omaha Tribe Reservation while the COVID-19 pandemic remains a threat to the tribal membership and all people who reside on the OMaha Tribe Reservation.  The Omaha Tribal Council finds this Temporary Curfew Order necessary in order to minimize in-person interaction, which is the primary means of transmission of COVID-19, or until it no longer poses a public health threat.  Curfew will be from 8:00 p.m. through 8:00 a.m. until further notice.  A weekly update will be made by tribal council.

1.  CURFEW

a.  A curfew for all persons shall be enforced daily between the hours of 8:00 p.m. through to 8:00 a.m.

  • During curfew hours, persons within the Omaha Tribe Reservation shall observe the SHELTER IN PLACE provisions set forth below including travel.
  • Persons traveling through the Reservation on a state highway are excempt as long as they do no stop within the Reservation boundaries.

b.  Persons engaging in essential work and essential travel are exempt, but such excempt persons shall try to use safety measures, such as wearing a mask, when engaging in essential work and travel.

2.  ENFORCEMENT

a.  All resolutions adopted by the Omaha Tribal Council specifically in relation to the public health emergency caused by the COVID-19 pandemic are enforceable by the local law enforcement.

b.  Travel Violations:

  • First Offense:        Warning
  • Second Offense:   Citation and $250.00 fine
  • Third Offense:       Vehicle Towed, Citation and $500.00 fine

c.  Walking During Curfew:

  • First Offense:        Warning
  • Second Offense:   Citation and $250.00 fine
  • Third Offense:       Citation and $500.00 fine

d.  House Gathering Violations During Curfew:

  • First Offense:        Warning
  • Second Offense:   Citation and $250.00 fine
  • Third Offense:       Citation and $500.00 fine
  • All violations will be reported to the Housing Programs if applicable.

e.  Gathering in Public Areas During Curfew:

  • First Offense:        Warning
  • Second Offense:   Citation and $250.00 fine
  • Third Offense:       Vehicle towed and/or Citation and $500.00 fine

3.  OMAHA TRIBAL GOVERNMENT OFFICES & SERVICE WILL BE SUSPENDED

Omaha Tribal Government offices and services will be suspended, with only essential and telework employees providing continuity of services.  The CTCHEC clinic and operations will continue to operate.

CERTIFICATION

This will certify that the foregoing resolution was considered at a meeting of the Tribal Council of the Omaha Tribe of Nebraska, duly called and held on April 17, 2020, and was adopted by a vote of 6 FOR, 0 AGAINST and 0 NOT VOTING OR ABSENT with the Chairperson not voting.  A quorum of 7 was present.
