VILLAGE OF WALTHILL

June 8, 2022

The regular meeting of the Chair and the Village Board of Trustees of Walthill, Nebraska was held at the Village Office in said village at 5:00 p.m., June 8, 2022.

Present:  Board Chair Michael Grant, Trustees Aaron Brown, Curtis Boschult and Gwen Porter, who excused herself from the meeting at 5:20 p.m.  Trustee Calvin McManigal was absent from the meeting.  Also present:  Lisa Beaudette, Village Clerk/Treasurer, KayCe Henneman, Deputy Clerk/Treasurer, Roger Anderson, Maintenance and James Randol Sr, Police Officer.  Matt Munderloh, Village Attorney, attended via zoom.

Visitors:  Michael Zavala-Taylor, Kailey Irwin, Cory Mugan, Ed Encinas Jr., and Brent Ciecior via zoom.

Notice of meeting was given in advance thereof by posting in three (3) public places, a designated method for giving notice, as shown by the certificate of posting notice on file at the Village Office.  Notice of the meeting was simultaneously given to the Chair and Trustees and a copy of their acknowledgment of receipt of notice and agenda are on file at the Village Office.  Availability of the agenda was communicated in the public notice.  All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.

Chair Grant called the meeting to order at 5:02 p.m. and made the public aware of the availability of the open meeting laws.

Trustee Porter made a motion, seconded by Brown to approve the minutes of the May 4, 2022 board meeting.  Upon roll call vote, the following voted aye:  McManigal, Porter and Boschult.  Nay:  None.  Abstain:  Brown.  Absent:  McManigal.  Motion carried.

Discussion was held on Garbage Collection Fees – no board action taken.

Trustee Porter excused herself from the meeting at 5:20 p.m.

Brent Ciecior, certified Street Superintendent from JEO Consulting Group, introduced himself as the Village’s new Street Superintendent and discussed the 1 & 6 Year Street Plan – no board action taken.

Community Development Report was submitted for the Board’s review.

Trustee Boschult made a motion, seconded by Brown to approve American Ramp Company’s Contract Change Order to add a 4’ T 16’ W X Series Mini-Ramp and a 38’ x 24’ concrete slab to the Skate Park Project for the price of $66,000.00.  Upon roll call vote, the following voted aye:  Grant, Brown and Boschult.  Nay:  None.  Absent:  McManigal and Porter.  Motion carried.

Chair Grant gave a walking trail update.

Ball Field Rental Agreement was discussed after which the Village Attorney was asked to draft a rental agreement to fit the Village’s needs.

Roger Anderson, Maintenance, gave a Maintenance Department report.

KayCe Henneman, Property Manager, gave an update on the Village’s rental properties.

Trustee Brown made a motion, seconded by Boschult to approve Jim Swanson’s quote to repair the 8-Plex trunk water line and branch valves for $2,850.00.  Upon roll call vote, the following voted aye:  Grant, Brown and Boschult.  Nay:  None.  Absent:  McManigal and Porter.  Motion carried.

Trustee Brown introduced Ordinance #2022-1 entitled:

AN ORDINANCE OF THE VILLAGE OF WALTHILL, NEBRASKA, AMENDING THE VILLAGE’S PERSONNEL POLICIES AND PROCEDURES MANUAL PROVIDING A WAGE INCREASE PER EACH WATER OPERATOR CERTIFICATION OR LICENSE OBTAINED BY ANY VILLAGE MAINTENANCE EMPLOYEE; PROVIDING ANY MAINTENANCE EMPLOYEE WHOSE OPERATOR CERTIFICATION OR LICENSE LAPSES IS SUBJECT TO A WAGE DECREASE; REPEALING ALL ORDINANCES, RESOLUTIONS, CODE SECTIONS, AND PARTS THEREOF IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE

and moved the statutory rule requiring reading on three days be suspended.  Trustee Boschult seconded the motion to suspend the rules and on a roll call vote, the following voted aye:  Grant, Brown and Boschult.  Nay:  None.  Absent:  McManigal and Porter.  The motion to suspend the rules was adopted by a majority of all members of the board that were present and the rule was declared suspended for consideration of said ordinance.

Said ordinance was then read by title and thereafter Trustee Brown moved for final passage of the ordinance, which motion was seconded by Trustee Boschult.  The Chairperson then stated the question “Shall Ordinance #2022-1 be passed and adopted?” Upon roll call vote, the following voted aye:  Grant, Brown and Boschult.  Nay:  None.  Absent:  McManigal and Porter.

The passage and adoption of said ordinance having been concurred in by a majority of all members of the Board of Trustees, the Chairperson declared the ordinance adopted and the Chairperson in the presence of the Board of Trustees signed and approved the ordinance and the Clerk attested the passage and approval of the same and affixed her signature thereto.  A true, correct and complete copy of said ordinance is as follows:

AN ORDINANCE OF THE VILLAGE OF WALTHILL, NEBRASKA, AMENDING THE VILLAGE’S PERSONNEL POLICIES AND PROCEDURES MANUAL PROVIDING A WAGE INCREASE PER EACH WATER OPERATOR CERTIFICATION OR LICENSE OBTAINED BY ANY VILLAGE MAINTENANCE EMPLOYEE; PROVIDING ANY MAINTENANCE EMPLOYEE WHOSE OPERATOR CERTIFICATION OR LICENSE LAPSES IS SUBJECT TO A WAGE DECREASE; REPEALING ALL ORDINANCES, RESOLUTIONS, CODE SECTIONS, AND PARTS THEREOF IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE

     BE IT ORDAINED by the Chairperson and Board of Trustees of the Village of Walthill, Nebraska:

   SECTION 1.  The Village’s Personnel Policies and Procedures Manual, Part IV, Compensation, A. Pay Policy, subsection (3)., shall be and hereby is amended to provide as follows:

“3). Pay adjustments in consideration of area living costs, area salary surveys, and the Village’s ability to pay may be granted annually, effective January 1.

In addition, the wage of any Village maintenance employee is subject to increase at any time in an amount determined by the Board of Trustees, subject to the Village’s ability to pay, upon the employee’s receipt of any water operator certification or license from the State of Nebraska, provided, however, the wage is subject to decrease in an amount determined by the Board of Trustees in the event the certification or license lapses, is not maintained, or is otherwise not current.”

     SECTION 2. Any other ordinance, resolution, Code section, or part thereof passed and approved prior to the passage, approval, and publication or posting of this Ordinance and in conflict with its provisions is hereby repealed.  Except as provided herein, no other provision of the Village’s Personnel Policies and Procedures Manual is repealed or amended.

     SECTION 3. This Ordinance shall take effect and be in full force from and after its passage, approval, and publication or posting as required by law.

     PASSED AND APPROVED this 8th day of June, 2022.

   SECTION 1.  The Village’s Personnel Policies and Procedures Manual, Part IV, Compensation, B. Fringe Benefits, shall, shall be and hereby is amended to provide as follows:

“13). Transfer of Vacation and Sick Benefits – Any employee who has accumulated vacation or sick leave benefits may transfer vacation, sick leave, or both from him- or herself to another Village employee for that employee’s use for the purposes as described herein.  Any such transfer shall be approved in advance by the employee’s immediate supervisor and one (1) member of the Board of Trustees, provided, however, if the transfer request is being made by a supervisor, it shall be approved by two (2) members of the Board of Trustees.”

     SECTION 2. Any other ordinance, resolution, Code section, or part thereof passed and approved prior to the passage, approval, and publication or posting of this Ordinance and in conflict with its provisions is hereby repealed.  Except as provided herein, no other provision of the Village’s Personnel Policies and Procedures Manual is repealed or amended.

     SECTION 3. This Ordinance shall take effect and be in full force from and after its passage, approval, and publication or posting as required by law.

Office Cross Training was discussed – no board action taken.

The Treasurer’s report for April 2022 was submitted for the Board’s consideration.  Since there were no objections, the report was filed.

Discussion was held on Payroll Direct Deposit – Village Clerk/Treasurer will look into it.

The bills were audited and a motion was made by Boschult, seconded by Brown, to approve payment.  Upon roll call vote, the following voted aye:  Grant, Brown and Boschult.  Nay:  None.  Absent:  McManigal and Porter.  Motion carried.

James Randol Sr, Police Officer, gave a verbal monthly Police Department report and an update on the Police Academy.

Discussion was held on Tee Pee Beautification – will wait until tee pee is fully finished.

The Recognizing Heroes Event sponsored by American Broadband has been cancelled at this time.

A reminder was given about the RLUIPA Training on June 15, 2022 at 5:00 p.m.

As there was no further business, a motion was made by Boschult, seconded by Brown to adjourn.  Upon roll call vote, the following voted aye:  Grant, Brown and Boschult.  Nay:  None.  Absent:  McManigal and Porter.  Motion carried.
